These Terms of Service ("Terms") govern your access to and use of Storm Deck. By accepting these Terms (via the in-app acceptance modal at first login, or by continuing to use Storm Deck), you agree to be bound by them. If you do not agree, do not use Storm Deck.
Storm Deck is operated by Vantx Holdings LLC ("we", "us", "our"), an Oregon limited liability company. Our service is designed for rural property owners, land stewards, and small fire operations teams who want a single dashboard for weather, fire detections, GPS, and incident tracking.
You agree not to:
You own the data you put into Storm Deck — your incident logs, property boundaries, notes, and uploaded files are yours. You grant us two licenses with respect to that data:
We will not sell your personal data, and we will not use your personal data to train third-party machine-learning models without your explicit consent.
Storm Deck aggregates data from public and commercial sources, including federal land-management and weather agencies, regional dispatch and emergency-management systems, commercial weather providers, and infrastructure-data providers. The current list of specific data subprocessors is available on request. We do not own or control this upstream data, and we cannot guarantee its accuracy, completeness, timeliness, or continued availability. If an upstream provider removes data, changes its terms, or goes offline, the affected Storm Deck features may become unavailable.
Storm Deck is currently provided at no charge during a limited preview while we finalize pricing and packaging. When paid plans become available, we will disclose the price, billing cycle, included features, and any refund terms at the time of purchase, and we will give existing users advance notice before any charge takes effect. After paid plans launch, continued use of features behind a paywall will require an active subscription; features that remain free will continue to be available without charge.
If you opt in, Storm Deck can send you text (SMS) messages — including service updates, notifications, and, where available, weather and storm information. Text messages are optional, are never a condition of creating or using a Storm Deck account, and are not a substitute for official emergency notifications (see the safety notice above).
Storm Deck is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that:
To the maximum extent permitted by law, in no event shall Storm Deck or Vantx Holdings LLC, or any of our officers, employees, contractors, or affiliates, be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to property damage, personal injury, loss of life, loss of profits, loss of data, or business interruption — arising out of or in connection with your use of (or inability to use) Storm Deck, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).
You agree to indemnify and hold harmless Storm Deck and Vantx Holdings LLC, and our officers, employees, contractors, and affiliates, from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, your violation of any third-party rights, or any content you upload to the service.
You may close your account at any time by emailing contact@stormdeck.app. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if we discontinue the service. On termination for any reason, your right to use Storm Deck ends immediately.
On written request received within 30 days of termination, we will provide a machine-readable export of your incident logs, parcel overlays, personnel records, locations, and lightning records for your property. After that window your data may be permanently deleted, except where longer retention is required by law or described in our Privacy Policy. Sections that by their nature should survive termination — including the Disclaimers, Limitation of Liability, Indemnification, and Governing Law sections — will continue to apply.
We may modify or discontinue Storm Deck — or any feature of it — at any time. For material changes to these Terms (changes that affect your rights, our liability, the data we collect, or the fees we charge), we will give registered account holders at least 30 days' advance notice by email or in-app notice before the change takes effect, and we will require you to re-accept the updated Terms at next login. The "Last updated" date at the top of these Terms always reflects the most recent revision. Your continued use of the service after a change takes effect constitutes acceptance.
We will not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, fire, power outages, internet service disruptions, acts of government, pandemics, or failure of third-party data providers. During any such event, our obligations under these Terms are suspended to the extent affected.
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the service shall be brought exclusively in the state or federal courts located in Wasco County, Oregon, and you consent to the personal jurisdiction of those courts.
